Bare & Fair — Terms of Service

Please read these Terms carefully before using our Site or placing an order.
1. Introduction
1.1 Agreement. By accessing bareandfair.ca (the "Site") or purchasing from Bare and Fair SkinCare Inc. ("Bare & Fair," "we," "us," "our"), you agree to these Terms of Service (the "Terms"). If you do not agree, please do not use the Site.
1.2 Hosted platform. Our storefront is hosted by Shopify Inc., which provides the e‑commerce platform we use to sell our products. Some services (checkout, payments, fraud screening) are provided through Shopify or its partners.
1.3 Age. You must be the age of majority in your province/territory or have parental consent to use the Site and place orders.
1.4 Updates. We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date at the top of this page. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
2. Definitions
"Products" means skincare, wellness and accessory items sold on the Site.
"Order" means your purchase request submitted via the Site.
"Business Days" means Monday–Friday, excluding Canadian statutory holidays.
"Consumer Laws" means applicable federal and provincial consumer protection legislation.
3. Order Processing & Fulfillment
3.1 Order acceptance. All Orders are offers to purchase. We may accept, reject, or limit quantities for any reason (including suspected fraud, inventory errors, or pricing inaccuracies). Acceptance occurs when we send a shipping confirmation.
3.2 Pre‑orders & backorders. Estimated ship dates are guides, not guarantees. We may ship items separately at no extra charge if needed.
3.3 Shipping & risk of loss. Title and risk of loss transfer when the carrier takes possession. Provide a complete, accurate shipping address; we are not responsible for delivery failures due to address errors. We ship via Canada Post and other carriers selected at our discretion. Orders are typically processed within 1–2 Business Days. Standard delivery within Canada takes approximately 5–7 Business Days.
3.4 Delivery regions. We currently ship to all provinces and territories within Canada only. PO Box delivery is supported via Canada Post. International shipping is not available at this time. Free standard shipping is offered on orders over $75 CAD.
3.5 Inspection on delivery. Please inspect your order upon receipt and contact us promptly if an item is defective, damaged, or incorrect so we can evaluate and make it right.
3.6 Consumer rights preserved. Your statutory rights under applicable provincial consumer protection laws remain unaffected by these Terms.
4. Payment Terms
4.1 Methods. We accept Visa, Mastercard, American Express, Shop Pay, Apple Pay, Google Pay, and PayPal via Shopify Payments and Stripe.
4.2 Authorization & charges. By submitting an Order, you authorize the payment processor to charge your payment method for the total amount, including taxes, shipping, and any applicable fees.
4.3 Taxes & currency. Prices are shown in Canadian Dollars (CAD) unless noted. Applicable taxes (GST/HST/PST/QST) are calculated at checkout based on your shipping address.
4.4 Third‑party processors. Payments may be processed by Shopify Payments and its sub‑processors. Bare & Fair does not store complete card details.
4.5 Fraud screening. Orders may be delayed or cancelled if flagged by fraud‑prevention systems.
5. All Sales Final Policy
5.1 No returns or exchanges. Due to the handcrafted nature and hygiene considerations of our skincare products, all sales are final. We do not accept returns, exchanges, or offer refunds for change of mind, incorrect product selection, or dissatisfaction with results.
5.2 Before you order. We encourage customers to carefully review product descriptions, ingredient lists (including INCI names), and usage instructions before purchasing. If you have questions about whether a product is suitable for your skin type or concerns, please contact us at hello@bareandfair.ca before placing your order.
5.3 Damaged items. If your order arrives damaged during shipping, contact us within 48 hours of delivery at hello@bareandfair.ca with photos of the damaged product and packaging. We will send a replacement at no additional cost.
5.4 Incorrect items. If you receive an incorrect item that differs from what you ordered, contact us promptly with your order number and a photo of the item received. We will ship the correct product to you.
5.5 Order cancellation. Orders may be cancelled within 2 hours of placement, provided they have not yet been processed for shipping. Contact us immediately at hello@bareandfair.ca to request cancellation.
6. Product & Content Disclaimers
6.1 No medical claims. Our Products are cosmetics/wellness goods and are not intended to diagnose, treat, cure, or prevent disease. Site content is informational and not a substitute for professional advice.
6.2 Ingredient transparency. We aim for accurate, complete ingredient lists, but formulations may evolve; always check packaging before use.
6.3 Patch testing & safety. Discontinue use and consult a professional if irritation occurs; keep Products out of reach of children.
7. Intellectual Property
7.1 Ownership. The Site and all content, logos, graphics, text, photographs, and product designs are owned by Bare & Fair or our licensors and protected by intellectual property laws.
7.2 Limited license. We grant you a limited, non‑exclusive, non‑transferable license to access and make personal, non‑commercial use of the Site. No rights are granted to copy, modify, create derivative works, resell, or exploit any part of the Site or content without our prior written consent.
7.3 User‑generated content (UGC). If you post reviews, photos, or comments, you grant Bare & Fair a worldwide, royalty‑free, perpetual license to use, reproduce, modify, publish, and display such UGC in any media for marketing and operational purposes, consistent with your privacy rights.
8. Privacy & Data Use
8.1 Privacy Policy. Your use of the Site is subject to our Privacy Policy, which explains what personal information we collect and how we use, disclose, and safeguard it in compliance with PIPEDA.
8.2 Platform hosting. Because our store is hosted on Shopify, certain data is stored and processed by Shopify and its sub‑processors (e.g., checkout, analytics, fraud prevention). See Shopify's policies and our Privacy Policy for details.
8.3 Marketing communications (CASL). If you opt in to receive emails or texts, you consent to receive commercial electronic messages from us. You can withdraw consent at any time via the unsubscribe link or by contacting us. We comply with Canada's Anti‑Spam Legislation (CASL).
9. Prohibited Uses
You may not use the Site (a) for unlawful purposes; (b) to violate any regulations, rules, laws, or local ordinances; (c) to infringe IP rights; (d) to harass, abuse, or harm others; (e) to submit false or misleading information; (f) to upload malware or interfere with security features; or (g) to scrape, crawl, or extract data without permission.
10. Warranties & Disclaimers
10.1 As‑is. The Site and all content are provided "as is" and "as available," without warranties of any kind except as expressly set out in these Terms and in your statutory consumer rights that cannot be limited by contract.
10.2 Service interruptions. We do not warrant that the Site will be uninterrupted, timely, or error‑free.
11. Limitation of Liability
To the maximum extent permitted by Canadian law, Bare & Fair and our directors, officers, employees, affiliates, agents, contractors, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost revenue, lost savings, loss of data, replacement costs) arising from your use of the Site or Products. In all cases, our aggregate liability for claims relating to the Site or Products shall not exceed the greater of CAD $100 or the amount you paid to us for the Product(s) giving rise to the claim in the 12 months preceding the claim. Your provincial statutory rights remain unaffected.
12. Indemnity
You agree to indemnify, defend, and hold harmless Bare & Fair and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, and employees from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or violation of any law or third‑party rights.
13. Dispute Resolution
13.1 Informal resolution. Contact hello@bareandfair.ca first; most issues can be resolved quickly.
13.2 Escalation. If we cannot resolve a dispute informally within 30 days, either party may pursue available remedies in accordance with Section 14 (Governing Law) and applicable Consumer Laws.
13.3 Consumer rights. Nothing in this section limits your right to bring a claim in small claims court or to exercise any non‑waivable rights under applicable Consumer Laws.
14. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Exclusive venue for any court proceeding is Vancouver, British Columbia, unless consumer protection law in your province grants you the right to bring claims locally.
15. Third‑Party Services & Links
Third‑party tools and links (e.g., payment gateways, shipping apps, Shop Pay) are provided "as is." We are not responsible for third‑party sites or services. Your use of them is governed by their terms and privacy policies (including Shopify Payments terms for card processing in Canada).
16. Errors, Inaccuracies & Availability
From time to time there may be information on the Site that contains typographical errors, inaccuracies, or omissions (e.g., pricing, promotions, shipping charges, availability). We reserve the right to correct any errors and to change or update information or cancel Orders if any information is inaccurate at any time (including after you have submitted your Order).
17. Promotions & Discount Codes
Any promotions or discount codes are subject to specific terms communicated at the time of the promotion. Unless otherwise stated, promotional offers are non‑transferable, have no cash value, cannot be combined with other offers, and may be withdrawn or modified at any time at our sole discretion.
18. Termination
We may suspend or terminate your access to the Site at any time without notice if you violate these Terms. You remain liable for all amounts due up to and including the date of termination.
19. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy and any order‑specific terms presented at checkout, constitute the entire agreement between you and Bare & Fair regarding your use of the Site and purchase of Products. They supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
21. Force Majeure
Bare & Fair shall not be liable for any delay or failure to perform obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, supply chain disruptions, carrier delays, labour disputes, government actions, power failures, or internet outages. We will use commercially reasonable efforts to resume performance as soon as practicable and will notify affected customers of material delays.
22. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Bare & Fair to be effective.
